This agreement (the “Terms”) is made between you (“User,” “Users,” or “you”) and Lumina Land SAS (“UniQ,” “the Company,” “we,” or “us”), the service operator, and governs your access to and use of UniQ’s products and services through our website and/or mobile app (the “Platform”). By using any services, features, or functions provided through the Platform (the “Services”), you agree to have read, understood, and accepted all of the terms and conditions outlined here, as well as our Privacy Policy.
This is a legally binding contract, so please read these Terms carefully before accessing the Platform. If you do not agree with any part of these Terms, you must refrain from using the Platform and its Services.
1. Scope of These Terms
1.1 These Terms govern the availability and use of UniQ’s Services. By registering for or using our Services, you accept these Terms.
1.2 UniQ may update these Terms at its sole discretion. Updated Terms will be communicated via the Platform, and your continued use of the Services constitutes your acceptance of the changes.
2. UniQ Services
2.1 UniQ provides a digital identity management platform enabling users to validate, manage, and share their identity credentials securely.
2.2 Users can only access the Platform and Services on their own behalf. Use of the Services on behalf of third parties without prior authorization is prohibited.
2.3 UniQ does not provide legal, financial, or investment advice. The Services are designed solely to enable digital identity management and related functionalities.
3. User Responsibilities
3.1 Users are responsible for safeguarding their account credentials and ensuring their secure use. Any activities performed through a user account are the sole responsibility of the account holder.
3.2 Users must notify UniQ immediately of any unauthorized access or use of their account.
3.3 Users are responsible for complying with all applicable tax obligations arising from their use of the Services in their jurisdiction.
4. Biometric Data Usage
4.1 UniQ requires the use of biometric data for certain levels of identity validation to ensure that users are who they claim to be.
4.2 Biometric data is processed securely, in compliance with international data protection standards, and exclusively for purposes of identity validation. UniQ also implements Zero-Knowledge Proofs (ZKP) to ensure selective privacy, sharing only the attributes necessary for validation.
5. Data Ownership and Usage
5.1 User Data: All personal data submitted by users remains their property. UniQ processes and stores user data solely to provide the Services and in accordance with the Privacy Policy.
5.2 Aggregated Data: UniQ may use anonymized, aggregated data derived from user activity to improve the Services, provided such data cannot identify individual users.
6. Relationships with Third Parties
6.1 UniQ works with trusted third-party providers for specific services (e.g., identity validation and secure storage).
6.2 UniQ audits its third-party providers periodically to ensure compliance with security and privacy standards.
6.3 Users retain full control over the data they share with third parties via the Platform
7. Service Availability and Technical Failures
7.1 While UniQ strives to provide uninterrupted service, it cannot guarantee availability at all times due to potential technical or external disruptions.
7.2 In case of service interruptions, UniQ will:
Notify users promptly.
Work to restore the service as quickly as possible.
Offer support to mitigate any inconvenience caused.
7.3 UniQ is not liable for losses resulting from service interruptions due to factors beyond its control, such as natural disasters, third-party issues, or technical failures
8. Termination of Services
8.1 Users may close their account at any time by contacting UniQ’s support team.
8.2 UniQ reserves the right to suspend or terminate user accounts if they violate these Terms or engage in prohibited activities.
8.3 Upon account termination, UniQ will delete user data, including biometric information and attributes, from its servers. However, certain exchange receipts may be retained for regulatory purposes.
9. Liability and Disclaimers
9.1 UniQ is not responsible for indirect, incidental, or consequential damages arising from the use of its Services.
9.2 The maximum liability of UniQ in any circumstance shall not exceed $50 USD.
9.3 Users waive any right to participate in class actions against UniQ.
10. Intellectual Property
10.1 UniQ owns all intellectual property rights related to the Platform, including but not limited to software, trademarks, and designs.
10.2 Users are granted a limited, non-transferable license to use the Platform and Services for personal purposes only.
10.3 Reverse engineering, redistribution, or unauthorized use of the Platform’s software or content is strictly prohibited.
11. Notifications of Consent
11.1 UniQ will notify users of updates to these Terms through email or in-app notifications, ensuring transparency and adequate communication.
11.2 Users will receive receipts for all data-sharing interactions, which will remain accessible in their account history.
12. Jurisdiction
12.1 All disputes arising from the use of the Platform or Services shall be governed by the laws of Argentina.
12.2 Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Buenos Aires, Argentina.
